Agreement to These Terms
Welcome to Logistik. These Terms of Service ("Terms") constitute a legally binding agreement between you and Logistik Tech ("Company," "we," "our," or "us"), governing your access to and use of the Logistik mobile application, website, and all associated services (collectively, the "Platform").
By downloading, installing, registering for, or using the Logistik App in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
Please read these Terms carefully. If you do not agree to any part of these Terms, you must immediately stop using the Logistik Platform and delete the App from your device. Your continued use of the App constitutes your ongoing acceptance of these Terms.
Eligibility
To use the Logistik Platform, you must meet the following eligibility requirements:
For Customers
- Be at least 13 years of age
- Have the legal capacity to enter into a binding agreement
- Provide accurate registration information
- Have a valid phone number and/or email address
For Riders
- Be at least 18 years of age
- Hold a valid Nigerian ID (NIN, Voter's Card, or Driver's License)
- Own or have legal use of a registered delivery vehicle
- Possess a valid Nigerian bank account for payouts
- Pass our identity verification process
By using the Platform, you represent and warrant that you meet all applicable eligibility requirements. If you do not meet these requirements, you are not permitted to use the Logistik Platform. We reserve the right to verify eligibility at any time and to suspend or terminate accounts that do not comply.
User Accounts
2.1 Account Registration
To access most features of the Logistik Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times. Providing false, misleading, or incomplete information may result in immediate account suspension or termination.
2.2 Account Security
- You are solely responsible for maintaining the confidentiality of your account credentials, including your password and any verification codes.
- You are responsible for all activities that occur under your account, whether or not you authorized them.
- You must notify us immediately at support@logistik.ng if you suspect unauthorized access to your account.
- We will not be liable for any loss or damage arising from your failure to maintain account security.
2.3 One Account Per Person
Each individual may maintain only one customer account and/or one rider account on the Platform. Creating multiple accounts to circumvent restrictions, bans, or verification requirements is strictly prohibited and may result in permanent termination of all associated accounts.
2.4 Account Verification
We may require additional verification steps at any time to confirm your identity, especially for rider accounts. You agree to cooperate with any reasonable verification process. Failure to complete verification may result in restricted access to Platform features.
User Obligations (Customers)
As a customer using the Logistik Platform to send packages, you agree to the following obligations:
Package Contents
- You must only use Logistik to send legal items. You are solely responsible for the legality and safety of everything you send.
- You must not ship items that are prohibited under Nigerian law, including but not limited to: controlled substances, illegal weapons, counterfeit goods, hazardous materials, or stolen property.
- You must accurately describe the contents of your package when placing a delivery order.
- You must ensure your package is securely and appropriately packaged to prevent damage during transit.
Accurate Information
- You must provide accurate pickup and drop-off addresses. Incorrect addresses that lead to failed deliveries may result in additional charges.
- You or an authorized representative must be available at the pickup location within the agreed timeframe.
- You must ensure the intended recipient is available to receive the package at the drop-off address.
Conduct
- You must treat all riders with respect and professionalism through all in-app communications.
- You must not request riders to perform activities outside the scope of a legitimate delivery.
- You are responsible for any additional costs arising from your error, including address corrections or re-deliveries.
Prohibited Packages: Sending illegal, hazardous, or harmful items is a serious violation that may result in immediate account termination, forfeiture of fees, and referral to law enforcement authorities. Logistik cooperates fully with Nigerian law enforcement on such matters.
Rider Obligations
As a rider on the Logistik Platform, you agree to the following standards and obligations. Failure to maintain these standards may result in suspension or permanent removal from the platform.
4.1 Independent Contractor Status
Riders on the Logistik Platform operate as independent contractors, not employees, agents, or partners of Logistik Tech. You are responsible for your own taxes, insurance, vehicle maintenance, fuel, and compliance with all applicable laws. Nothing in these Terms creates an employment relationship between you and Logistik Tech.
4.2 Professional Standards
- Maintain a professional and courteous demeanor with all customers at all times
- Pick up packages promptly after accepting a delivery request
- Deliver packages to the correct destination without unauthorized stops, detours, or delays
- Handle all packages with reasonable care to prevent damage or loss
- Provide proof of delivery as required by the Platform
- Respond to customer messages in a timely and professional manner
4.3 Vehicle & Safety Requirements
- Maintain your delivery vehicle in a roadworthy condition at all times
- Comply with all Nigerian road traffic laws, including wearing a helmet when required
- Ensure your vehicle registration and any required permits remain valid and current
- Never operate your vehicle under the influence of alcohol, drugs, or any substance that impairs judgment
4.4 Package Integrity
- Never open, tamper with, inspect, or interfere with any package assigned to you
- If a package appears damaged, illegal, or suspicious, contact Logistik Tech support immediately before proceeding
- In the event of accidental damage to a package, report it immediately through the app
4.5 Earnings & Ratings
Earnings are calculated based on completed deliveries according to the rates communicated to you in the rider application and within the App. Logistik Tech reserves the right to adjust delivery rates with reasonable notice. Your performance rating, based on customer feedback, affects your delivery assignment priority. Consistently low ratings may result in account review or suspension.
Deliveries & Orders
5.1 Order Placement
When you place a delivery order through the Logistik App, you are making a request for delivery services. Logistik Tech will use reasonable efforts to match your request with an available rider, but we do not guarantee that a rider will always be available in your area at any given time.
5.2 Cancellations
- Customer cancellations: You may cancel an order before a rider accepts it at no charge. Cancellations made after a rider has accepted and is en route to the pickup location may incur a cancellation fee.
- Rider cancellations: Riders may cancel accepted orders only in exceptional circumstances. Frequent unexplained cancellations by riders may result in account penalties.
- Platform cancellations: Logistik Tech may cancel an order if a rider cannot be found within a reasonable time, or if a safety concern is identified.
5.3 Delivery Timeframes
Estimated delivery times displayed in the App are estimates only, not guarantees. Actual delivery times may vary due to traffic, weather, road conditions, or other factors beyond our control. Logistik Tech is not liable for delays caused by circumstances outside of our reasonable control.
5.4 Failed Deliveries
If a delivery cannot be completed because the recipient is unavailable or provides an incorrect address, the package may be returned to the sender. Return deliveries may incur an additional fee. If a package cannot be delivered or returned successfully, Logistik Tech will contact you to arrange resolution.
5.5 Loss or Damage
While Logistik Tech takes reasonable precautions to ensure safe delivery, we strongly recommend that customers do not ship items of high monetary or sentimental value without appropriate personal insurance. Our liability for loss or damage is limited as described in Section 10 of these Terms.
Payments & Fees
6.1 Delivery Fees
Delivery fees are calculated and displayed to you before you confirm an order. Fees are based on factors including delivery distance, package size, and current demand. By confirming an order, you agree to pay the quoted fee. All prices are displayed in Nigerian Naira (NGN).
6.2 Payment Methods
Logistik Tech accepts payment through the methods available within the App at the time of your order. You agree to maintain valid and current payment information in your account. Logistik Tech uses secure, third-party payment processors and does not store your full payment card details on our servers.
6.3 Rider Payouts
- Rider earnings are calculated per completed delivery based on the rate schedule communicated within the App
- Payouts are disbursed to the rider's registered bank account on the schedule communicated in the rider portal
- Logistik Tech reserves the right to withhold payouts pending investigation of a dispute, fraud, or policy violation
- Riders are responsible for all applicable taxes on their earnings as independent contractors
6.4 Refunds
Refunds may be issued at Logistik Tech's discretion in cases of verified service failures, such as non-delivery or significant damage caused by a rider. Refund requests must be submitted through the App or to support@logistik.ng within 48 hours of the delivery event. We will review each request individually and communicate our decision within 5 business days.
Delivery fees are non-refundable for successfully completed deliveries, except in cases of verified error or misconduct on the part of the assigned rider. Disputes about completed deliveries must be raised promptly.
Prohibited Conduct
The following conduct is strictly prohibited on the Logistik Platform. Engaging in any of these activities may result in immediate account suspension, permanent termination, forfeiture of funds, and/or referral to law enforcement.
Platform Misuse
- Using the Platform for any purpose that is unlawful, fraudulent, or harmful
- Creating fake accounts, impersonating other users, or misrepresenting your identity
- Attempting to circumvent, hack, or reverse-engineer any aspect of the Platform
- Submitting false delivery reports, fake reviews, or fraudulent payment claims
- Using automated tools, bots, or scripts to interact with the Platform
- Interfering with the Platform's infrastructure, servers, or networks
Harmful Content & Conduct
- Sending abusive, threatening, harassing, or discriminatory messages to other users or riders through in-app chat
- Sharing another user's personal information without their consent
- Engaging in any activity that creates a safety risk for riders, customers, or the public
- Colluding with another user to manipulate delivery fees, ratings, or payouts
Prohibited Shipments
- Illegal drugs, controlled substances, or drug paraphernalia
- Illegal weapons, ammunition, or explosives
- Stolen goods or items of fraudulent origin
- Counterfeit or pirated goods
- Hazardous materials, flammable liquids, or dangerous chemicals
- Human remains, live animals, or perishables without proper disclosure
- Any item prohibited by Nigerian federal or state law
Intellectual Property
All content, features, and functionality of the Logistik Platform — including but not limited to the App design, logos, text, graphics, software, source code, and the "LOGISTIK" name and brand — are owned by Logistik Tech or its licensors and are protected by Nigerian and international intellectual property laws.
License to Use
Subject to your compliance with these Terms, Logistik Tech grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Logistik App solely for its intended purpose of requesting or providing delivery services. This license does not include any right to sublicense, sell, resell, modify, adapt, or create derivative works based on the Platform.
Restrictions
- You must not copy, reproduce, distribute, or publicly display any part of the Platform without our prior written permission
- You must not remove, alter, or obscure any copyright, trademark, or proprietary notices on the Platform
- You must not use Logistik's name, logo, or branding in any way that suggests endorsement or affiliation without our written consent
Disclaimers
9.1 Platform Availability
Logistik Tech provides the Platform on an "as is" and "as available" basis. We do not warrant that the App will be available, uninterrupted, error-free, or free from viruses or other harmful components at all times. We may suspend or modify the Platform at any time for maintenance, updates, or other operational reasons.
9.2 Third-Party Actions
Logistik Tech acts as a technology platform connecting customers and independent riders. We do not control the actions of riders and cannot guarantee the behavior, performance, or conduct of any individual rider. While we screen and verify riders, we cannot warrant that every rider will perform to the highest standard on every delivery.
9.3 Route & ETA Accuracy
Estimated delivery times and route suggestions displayed in the App are generated using third-party mapping services (Google Maps). These estimates are provided in good faith but are not guarantees. Traffic, road conditions, and other factors may cause actual delivery times to differ from estimates.
To the fullest extent permitted by applicable Nigerian law, Logistik Tech disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, in connection with the Platform and any delivery services facilitated through it.
Limitation of Liability
To the maximum extent permitted by applicable law, Logistik Tech, its directors, employees, agents, and partners shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
- Loss of profits, data, goodwill, or business opportunities resulting from use or inability to use the Platform
- Loss, theft, or damage to packages during transit beyond the direct negligence of an assigned rider
- Delays in delivery caused by traffic, weather, force majeure, or other circumstances beyond our reasonable control
- The conduct, actions, or omissions of independent riders on or off the Platform
- Any third-party service failures, including payment processors, mapping services, or cloud infrastructure
Maximum Liability Cap
In cases where Logistik Tech is found liable despite the above, our total liability to you for any single claim or series of related claims shall not exceed the total delivery fees you paid to Logistik Tech in the 30 days preceding the event giving rise to the claim. This cap reflects the nature of our role as a platform intermediary.
Nothing in these Terms excludes or limits liability for death or personal injury caused by Logistik Tech's negligence, fraud, or any other liability that cannot lawfully be excluded under applicable Nigerian law.
Termination
11.1 Termination by You
You may close your Logistik account at any time by using the account deletion feature within the App or by contacting us at support@logistik.ng. Termination will be processed within 30 days. Any outstanding delivery fees or rider earnings due at the time of termination will still be collected or disbursed as applicable.
11.2 Termination by Logistik Tech
We reserve the right to suspend or permanently terminate your account, with or without notice, if we reasonably believe you have:
- Violated any provision of these Terms or our Community Guidelines
- Engaged in fraudulent, illegal, or harmful conduct on the Platform
- Provided false or misleading information during registration or verification
- Posed a risk to the safety of other users, riders, or the public
- Repeatedly failed to meet the minimum standards expected of your role (customer or rider)
11.3 Effect of Termination
Upon termination, your license to use the Platform immediately ends. Sections of these Terms that by their nature should survive termination — including payment obligations, intellectual property rights, disclaimers, limitations of liability, and dispute resolution — shall continue to apply.
Disputes & Governing Law
12.1 Informal Resolution First
We encourage you to contact us first before pursuing any formal legal action. If you have a dispute with Logistik Tech, please reach out to our support team at support@logistik.ng. We commit to making a good-faith effort to resolve disputes informally within 14 business days of receiving your complaint.
12.2 Disputes Between Users
Logistik Tech is not a party to disputes between customers and riders. If a dispute arises between you and another user (for example, a disagreement about package contents or delivery), Logistik Tech may assist in mediation at our discretion but is under no obligation to resolve such disputes. Each party is responsible for resolving their own disputes.
12.3 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Edo State, Nigeria.
We value every user of the Logistik Platform and are committed to resolving concerns fairly and promptly. Please contact us first — most issues can be resolved quickly through our support team without the need for formal proceedings.
Changes to These Terms
Logistik Tech reserves the right to modify these Terms at any time to reflect changes in our services, operations, or legal requirements. When we make changes, we will:
- Update the Effective Date at the top of this page
- Send registered users an in-app notification or email informing them of material changes
- For changes that materially affect your rights or obligations, provide at least 14 days' notice before the new Terms take effect
Your continued use of the Logistik Platform after the revised Terms take effect constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Platform and close your account before the changes take effect.
The most current version of these Terms will always be accessible within the App and on our website. We encourage you to review these Terms periodically.
